CWPT PACKAGES AGREEMENT
1. Introduction
These Terms and Conditions govern the use of all services provided by Christian Williams Personal Training (CWPT), including online coaching programs, consultations, personal training sessions, and related activities (collectively referred to as “Services”). By accessing or using our Services, you agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these Terms and Conditions, you must not use our Services.
2. Program Objectives and Procedure
2.1 General Statement
The coaching programs are designed to enhance cardiovascular health, build muscular strength and endurance, improve flexibility, and optimize body composition. These programs include a variety of exercises such as aerobic activities (e.g., walking, running, cycling), weightlifting, and flexibility exercises.
– Silver Program: Focus on cardiovascular health, muscular strength, endurance, flexibility, and body composition.
– Gold Program: Similar to the Silver Program, with an additional focus on muscle tone and strength.
– Platinum Program: Similar to the Gold Program, with the addition of personal training sessions.
2.2 Nutritional Guidance
Each program incorporates a nutritional guide aimed at supporting weight loss, muscle tone, and overall well-being. These guides include video content for better understanding and advice. However, it is crucial to consult a licensed dietitian for personalized diet prescriptions. The nutritional support provided by CWPT is meant as a general guide and not as a substitute for professional advice.
2.3 Supplement and Recovery Guidance
Recommendations on supplements, massage, foam rolling, and stretching are provided to assist you. These are intended as guidance only and should not replace professional medical or nutritional advice.
Ensure that you consult with your healthcare provider before undertaking any new procedures or taking supplements.
2.4 Description of Potential Risks
Engaging in physical exercise involves inherent risks, including but not limited to abnormal changes in blood pressure, cardiovascular events, musculoskeletal strains, and injuries. By participating in the program, you acknowledge these risks and agree that CWPT is not liable for any damages or injuries sustained during or after participation. You assume full responsibility for any potential injuries or damages.
2.5 Description of Potential Benefits
Regular participation in the programs can lead to numerous health benefits such as improved cardiovascular fitness, increased muscular strength, enhanced body composition, reduced risk of chronic diseases, weight loss, and overall improved well-being. By engaging in the program, you understand and acknowledge these potential benefits and agree to adhere to the program to achieve optimal results.
3. Program Details
3.1 Enrolment
Access to the online coaching programs begins upon downloading our app or accessing the desktop version. The program includes a familiarization period, followed by scheduled weekly activities, workouts, step goals, nutritional advice, and weekly guides. You will also receive access to a suggested meal plan, recovery guide, supplement guide, community support, and team calls throughout the program.
3.2 Duration
Each program phase lasts for 6 or 12 weeks, depending on the package, with additional access granted for one week before and one week after this period to ensure smooth onboarding and to accommodate any missed time. For longer programs, such as 6 months, access will be provided accordingly. Extended access and potential discounts may be available upon upgrade but are not guaranteed.
– Silver Program: 12-week duration.
– Gold Program: 6-week duration, with a potential 6-month expiry for session completion.
– Platinum Program: Similar to Gold, with additional access to personal training sessions.
3.3 Access Termination
Once your program concludes, you will not be granted additional requests to share or access any materials from the software. Guides will be provided on how to download materials before access ends, allowing you to retain them for future reference.
3.4 Content
The programs include instructional videos, PDF documents, and in-app messages designed to enhance engagement and results. These resources aim to support you throughout the program.
3.5 Program Expiry
All sessions signed up for, or program durations, will have a 6-month period of completion unless the package is for a longer duration. This means that if you sign up for a block of sessions, you have 6 months to ensure they are all used, or you will lose the right to book them later. This is also the case for any online program; after payment has been made, you may choose to hold off the start date, but the program will have the same expiry date, 6 months from purchase.
4. Client Responsibilities
4.1 Health and Safety
You must be in good health and have obtained medical clearance before starting the program. CWPT is not liable for any health issues arising from participation.
4.2 Use of Equipment
You must have access to basic gym equipment as specified or be willing to adapt alternative exercises under CWPT’s guidance. Essential equipment includes, but is not limited to, a treadmill, rowing machine, stationary bike, cable machine, Lat pull-down, Lat row, dumbbells, bench, smith machine, and step. The program starts with basic exercises and progresses to more advanced ones. Video tutorials will provide alternatives if specific equipment is unavailable.
4.3 Communication
Support is provided through different communication channels based on the program:
– Silver Program: Support is provided via scheduled team calls every three weeks by our support team, who are not certified health professionals. Direct communication with a personal trainer is not included.
– Gold Program: Includes direct communication with a personal trainer/fitness coach via the app’s chat portal and scheduled team calls every three weeks. Virtual meetings are held every 6 weeks to recap and review.
– Platinum Program: Similar to the Gold Program, with the addition of personal training sessions and more frequent direct communication with a personal trainer.
4.4 Personal Training Sessions (Platinum Program Only)
Personal training sessions will start and finish on time, so clients should aim to be a few minutes early to warm up beforehand. Full focus and compliance with the trainer are required, including leaving distractions aside to concentrate on goals. If a session is cancelled with less than 12 hours’ notice, the session will be deducted from the total. If a client cancels more than three times within the 12-hour period, a separate meeting will be arranged to reassess the program’s suitability for the client’s lifestyle and schedule.
5. Payment and Cancellation Policy
5.1 Payment
Full payment is required before the commencement of any program. Payment terms and methods will be detailed during enrolment.
5.2 Cancellation
If access has been granted and the program has not started, a 50% refund may be issued within the first 7 days of program sign-up and payment. No refunds will be provided once the program has begun.
5.3 Refund Policy
Once access to the program is granted and the program has commenced, no refunds will be issued, even if you have logged in or used the materials. All documents and videos are accessible immediately upon login.
5.4 Payment Instalment Agreement (Gold and Platinum Programs Only)
In some cases, we can offer an instalment plan to help benefit from a discounted package but allowing the payment to be broken down to 6-week instalments. These must be paid on time, or you risk the access of the software and the support from the team.
6. Confidentiality and Data Protection
CWPT is committed to protecting the confidentiality of all personal information provided by clients. Personal information will not be disclosed without consent, except as required by law. CWPT retains copyright ownership of all programs, and these programs may not be shared or sold. User login is for one individual and one device at a time.
7. Amendments and Modifications
CWPT reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any changes, which will be effective immediately upon posting.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Dubai, United Arab Emirates.
9. Prizes
Throughout the program duration, CWPT may offer prizes as recognition for efforts during scheduled meetings or calls. These prizes will be awarded after the program ends.
10. Acceptance of Terms
By enrolling in any of the CWPT Online Coaching Programs, you signify your acceptance of these Terms and Conditions and agree to comply with all stated policies and procedures.
11. Agreement Confirmation
I have read and understood the terms outlined above. I acknowledge that I have had the opportunity to ask questions, and all my questions have been answered to my satisfaction.
